Motivation serves as a pivotal driver for achieving optimal work performance, especially in the realm of local government operations. Through a qualitative multiple-case study design, the researchers analyzed the pivotal connection between employees' performance and overall organizational success. Thirteen (13) participants from the first-class municipalities in the first district of Batangas were selected using purposive sampling techniques. Face-to-face interviews were conducted to get the opinions of the participants and were subsequently subjected to thematic analysis. The findings highlight the strong connection (...) between motivational tools and employee preferences. Despite the local government's emphasis on teamwork and collaboration, employees exhibit a strong preference for incentives, rewards, and acknowledgment. Advocating for the systematic integration of employee feedback into motivational strategy formulation and the necessity of comprehensive evaluations of existing tools. Additionally, it underscores the importance of cultivating an inclusive environment where employees actively participate in discussions about motivational approaches. By embracing the proposed motivational plan that considers both organizational and employee perspectives, this research seeks to cultivate a culture of heightened productivity and performance enhancement within local government units. The Planteome project provides a suite of reference and species-specific ontologies for plants and annotations to genes and phenotypes. Ontologies serve as common standards for semantic integration of a large and growing corpus of plant genomics, phenomics and genetics data. The reference ontologies include the Plant Ontology, Plant Trait Ontology, and the Plant Experimental Conditions Ontology developed by the Planteome project, along with the Gene Ontology, Chemical Entities of Biological Interest, Phenotype and Attribute Ontology, and others. The project also provides (...) access to species-specific Crop Ontologies developed by various plant breeding and research communities from around the world. Where three teacher-researchers discuss bipedal walking in humans and where the long-term dynamics of this phenomenon are interpreted in terms of complexity and predictability, two concepts that can be quantified using fractals and the mathematical tools to study them.

The literature of Twelve Step groups such as Alcoholics Anonymous contains apparently contradictory implications regarding powerlessness and personal responsibility. In this essay I examine the treatment of these concepts in Twelve Step literature and their implications for the self-conception of people in these programs. In the first section, I examine the literature to demonstrate that addicts are presented as powerless over, yet responsible for, their addictive behaviors. In the second section, I outline two potential ways people in Twelve Step programs (...) might reconcile this contradiction within their self-conception, but I argue that neither is satisfactory. In the third section, I draw on Paul Ricoeur's theory of narrative identity to develop an account of how someone ni a Twelve Step group could coherently understand herself as both powerless and responsible. Programs of drug testing welfare recipients are increasingly common in US states and have been considered elsewhere. Though often intensely debated, such programs are complicated to evaluate because their aims are ambiguous – aims like saving money may be in tension with aims like referring people to treatment. We assess such programs using a proportionality approach, which requires that for ethical acceptability a practice must be: reasonably likely to meet its aims, sufficiently important in purpose as to outweigh harms incurred, (...) and lower in costs than feasible alternatives. In the light of empirical findings, we argue that the programs fail the three requirements. Pursuing recreational drug users is not important in the light of costs incurred, while dependent users who may require referral are usually identifiable without testing and typically need a broader approach than one focussing on drugs. Drug testing of welfare recipients is therefore not ethically acceptable policy. (shrink)

Devant le constat du déclin toujours plus rapide de la diversité biologique et les limites des res- sources disponibles pour l’enrayer, il est nécessaire de déterminer quels moyens devraient être engagés dans sa protection. Pour ce faire, une méthode efficace serait d’évaluer les bénéfices tirés de la biodiversité afin d’estimer rationnellement les coûts légitimes de sa protection. L’évaluation économique, qui se présente d’emblée sur un mode quantitatif, serait alors un outil précieux. Dans ce texte, nous présentons différentes méthodes d’évaluation économique (...) de la biodiversité ainsi que certaines de leurs limites méthodologiques. Par la suite, nous montrons qu’en dépit de ses avantages pratiques, l’évaluation économique échoue à représenter l’ensemble des valeurs en jeu dans la protection de la biodiversité. Nous décrivons alors trois types de valeurs incommen- surables avec des bénéfices économiques : la valeur de legs, qui renvoie aux obligations de trans- mission du patrimoine naturel dont nous avons hérité ; la valeur d’existence, qui renvoie à la considération morale d’intérêts autres que ceux des êtres humains ; la valeur de transformation, qui renvoie à la capacité d’examiner et de critiquer nos préférences et inclinaisons afin d’inclure celles-ci dans une vision du monde rationnelle et cohérente. Pour conclure, nous plaidons en faveur de l’élaboration de méthodes de concertation et d’évaluation participatives et pluralistes permettant de rendre compte de la diversité et de l’hétérogénéité des valeurs de la biodiversité. Functional diversity holds the promise of understanding ecosystems in ways unattainable by taxonomic diversity studies. Underlying this promise is the intuition that investigating the diversity of what organisms actually do—i.e. their functional traits—within ecosystems will generate more reliable insights into the ways these ecosystems behave, compared to considering only species diversity. But this promise also rests on several conceptual and methodological—i.e. epistemic—assumptions that cut across various theories and domains of ecology. These assumptions should be clearly addressed, notably for the sake (...) of an effective comparison and integration across domains, and for assessing whether or not to use functional diversity approaches for developing ecological management strategies. The objective of this contribution is to identify and critically analyze the most salient of these assumptions. To this aim, we provide an “epistemic roadmap” that pinpoints these assumptions along a set of historical, conceptual, empirical, theoretical, and normative dimensions. (shrink)

This study explored the integration of play-based learning strategies within teaching practices, examining the types of activities, their frequency, and alignment with the curriculum. A single public primary school in Gasabo District was purposefully selected for its unique approach to implementing play-based learning, which had not been examined in previous research. The participants included all 26 teachers at the school, consisting of 18 women and 8 men. Employing a qualitative approach, the study utilized semi-structured interviews to investigate into the dynamics (...) of play-based learning. Data analysis involved thematic coding to identify core themes, with participant responses triangulated across various sources and validated through member checking. The findings have shown a different array of play-based activities, with role-playing and storytelling standing out as the most frequently utilized. While some teachers readily incorporated these strategies into their daily lessons, others struggled due to time limitations and curriculum weights. Despite these challenges, the teachers acknowledged the significant benefits of play-based learning in enhancing student engagement, motivation, and socio-emotional development. These insights highlighted the potential of such strategies to transform classroom practices and raise a more interactive and supportive learning environment. To address the identified challenges, the study recommends sustained professional development programs and increased support for teachers to integrate play-based learning effectively. It emphasizes the need for collaborative efforts between policymakers and teachers to reduce barriers such as rigid curricula and time constraints. By aligning policy and practice, the study advises for the optimization of play-based approaches, ensuring their positive impact on Rwandan classrooms is maximized. (shrink)

This study was intended to determine the level of factors affecting the decision of 4th year BS Accountancy students from College of Maasin to work after graduation or to take the 2022 CPALE. In order to determine the factors affecting the decision of the graduating Accountancy students, the researchers adopted the descriptive survey design. Descriptive survey is a sort of descriptive study that uses surveys to collect data on a variety of issues. The goal of this information is to see (...) how different circumstances can be obtained among the respondents. The following results were derived in the course of the conduct of this study; There is bigger percentage of female than of male where 26 out of 27 belongs to the age group of 20 to 22. Majority of the student’s parent’s occupation status is working. Conversely, most of them only earns P2,000 to P5,000 per month even though the household member earning for a living is 1 to 4 members, the first 3 factors namely financial status, peer pressure and parent’s influence were found to slightly affect the decision of the student with regards to taking the CPALE or to work after graduation. The last factor, school’s teaching influence turned out that it somewhat affects the decision of the students, there is a significant difference between the teaching influence factor and the demographic profile of gender while on the age and parent’s occupation status, it has a significance difference with financial status factor. As BSA students taking a course where a licensure examination awaits after graduation, it is necessary to take some factors into consideration before coming up into a decision regarding taking the CPALE or to work after graduation. Based on the results of the study, the level of factors to affect the decision of the students was determined. It has been shown in the results that the three factors namely financial status, peer pressure and parent’s influence can slightly affect the student’s decision. However, among three, peer pressure has the highest weighted mean rating of 2.86. On the other hand, the school’s teaching influence has the lowest weighted mean rating of 2.29 which means it can somewhat affect the decision of the student. (shrink)

Physicien théoricien, philosophe de la physique et historien des théo­ries physiques, le savant catholique français Pierre Duhem (1861-1916) a profondément marqué la pensée du vingtième siècle. Chacun connaît le Système du monde, dont les dix volu­mes ont contribué à la redécouverte de la science médiévale, et La théorie physique, qui a notamment donné lieu à la célèbre «thèse Duhem-Quine». Si Clio a donc gardé de Duhem le sou­venir d’un grand historien des sciences et d’un philosophe perspicace de la physique, lui-même (...) cependant n’aspirait qu’à être reconnu comme physicien. Son œuvre est en effet traver­sée par un projet scientifique qui consiste à ordonner et à réunir les diverses branches de la physique sous l’égide de la thermo­dynamique dans le cadre d’une théorie représentative et non explicative du réel. C’est ce projet que Duhem a voulu réaliser dans ses publications scientifiques, exposer dans ses écrits philoso­phiques, et finalement cautionner par ses recherches historiques. Cependant l’investissement toujours plus important de Duhem en histoire des sciences et la présence dans son œuvre de con­sidéra­tions apologétiques et d’écrits patriotiques peuvent don­ner à penser qu’il s’est progressivement détourné de ce projet primordial au profit d’autres préoccupations. De même, les tensions qui, à l’inté­rieur de ce projet scientifique, subsistent entre sa volonté unificatrice et sa revendication phénoménaliste peuvent conduire à une relativi­sation de cette dernière, conçue comme une demande contextuelle, passa­gère et finalement peu significative. Sans ignorer ces préoccu­pations historiques, religieuses ou patriotiques, sans négliger ce con­flit d’intérêt entre les deux parties constitutives du projet duhémien, cette étude entend tout d’abord réaffirmer que ce projet scientifique ne sera jamais ni abandonné, ni amputé. Toutefois, dès lors que sont maintenues la permanence, la prio­rité et l’intégralité de ce projet, trois paradoxes surgissent im­médiatement. Si Duhem se voulait avant tout physicien et souhaitait être reconnu comme tel, par quelle extravagance de l’histoire est-il finalement connu pour ses recherches histori­ques et ses travaux philosophiques et non pour ce qui lui tenait le plus à cœur? S’il ne voulait être qu’un illustre physicien, pourquoi s’est-il acharné, au retour du laboratoire, à exhumer de l’oubli les manuscrits et les théories scientifiques des au­teurs médiévaux? Enfin, s’il voulait vraiment établir une physi­que qui soit unifiée, cohérente et parfaite, pourquoi se prive-t-il du réa­lisme et s’embarrasse-t-il du phénoménalisme? Basée sur la corres­pondance inédite de Duhem, cette étude, centrée plus particu­liè­rement sur ce troisième paradoxe, contribue fina­lement à élucider chacun d’eux. (shrink)

From Karl Marx to the early Frankfurt School theorists, into other critical traditions through the twentieth and into the twenty-first century, critical social theorising has both implicitly and explicitly concerned itself with matters pertaining to nature as part of differing critiques of the destructive unfolding of late-industrial capitalism (and beyond). Horkheimer himself notes, in a defining essay that gave shape to Frankfurt School Critical Theory, Traditional and Critical Theory (1937), that “[the subject of critical thinking] is rather a definite individual (...) in his real relation to other individuals and groups, in his conflict with a particular class,and, fi nally, in the resultant web of relationships with the social totality and with nature” (Horkheimer 1937 [1972]: 211) [emphasis added]. What, one may ask, is meant by this concept of ‘nature’? In Western philosophical thought, there are countless definitions and conceptions of the term, from the Greek and Roman philosophers, through different Christian theologies, the scientific turn of philosophical thought, the reaction by the Romanticists, into the more secular context of modern and postmodern philosophy and related paradigms. Nature is often placed into tension with culture, with nature referring to the separation of human from non-human (ecological environments, animals, plants, minerals, bacteria, weather patterns, etc.). However, more recent writings in the social sciences have questioned this duality as obfuscating their crucial interconnections. (shrink)

La thématique de ce recueil collectif consacré à l' esprit démocratique est mise à l' enseigne du célèbre discours de Benjamin Constant comparant, au nom de l'idéal démocratique, la liberté politique des Anciens et celle qui se décline chez les Modernes. Comme le résume Jean-Marc Narbonne dans l'une de ses conférences : « Dans une démocratie directe [...] la nécessité du sacrifice des intérêts privés au profit du service à la collectivité peut faire craindre la disparition ou l' effacement (...) des aspirations personnelles ; dans une démocratie indirecte, plus encline à promouvoir la poursuite individuelle du bonheur et les bénéfices parti-culiers, c' est en revanche l'intérêt pour la chose publique en général qui risque de faire défaut [...] et qu'il s' agit de préserver. » Pour éviter ce double danger, à savoir l' embrigadement de l'individu d'un côté, la dislocation du lien social de l' autre, il faut combiner et maintenir fermement ensemble, comme le réclamait Constant lui-même, ces deux formes de liberté. A função e o sentido do casamento são apresentados por Mary Wollstonecraft (1759-1797), em “Reivindicação dos direitos da mulher” (1792). Escrito em formato de reunião de panfletos e publicado antes de partir para a França revolucionária, com o propósito de acompanhar o levante republicano contra o Antigo Regime, “Reivindicação dos direitos da mulher” contém uma denúncia generalizada da desigualdade de gênero e de seus efeitos deletérios, e um projeto de reforma das instituições e da sociedade. É nesse texto que a (...) filósofa teoriza de maneira consistente e fecunda, sobre o casamento como instituição central a ser transformada, e é também ao tratar do casamento que a filósofa de fato opera com os conceitos de direitos e obrigações. “Reivindicação dos direitos da mulher” tem “direitos” no título, mas é de fato um livro sobre educação e sua argumentação se ergue sobre um pressuposto metafísico, a partir e contra a teoria da liberdade de Jean-Jacques Rousseau. Neste estudo, apresento como a categoria do casamento como instituição pedagógica e política desempenhar papel estruturante na transformação da sociedade. A função do casamento, para a filósofa, é articular as esferas privada e pública, de maneira engajada nos requisitos revolucionários, como uma categoria da transformação social. Este é o sentido da noção de “cimento da sociedade” que pretendo apresentar. (shrink)

In the Sociology of Emotion and Affect Studies, affects are usually regarded as an aspect of human beings alone, or of impersonal or collective atmospheres. However, feelings and emotions are only specific cases of affectivity that require subjective inner selves, while the concept of ‘atmospheres’ fails to explain the singularity of each individual case. This article develops a theory of social affect that does not reduce affect to either personal feelings or collective emotions. First, I use a Spinozist understanding of (...) the ‘body’ to conceptualize the receptivity and mutual constitution of bodies, to show how affects do not ‘belong’ to anybody; they are not solely attributable either to the human or to any kind of body alone, but emerge in situations of the encounter and interaction (between bodies). Next I build upon Jean-Marie Guyau’s concept of transmissions to show how we can theorize affect as an emerging transmission between and among bodies. Finally, I demonstrate how we now have a complete conceptual frame for theorizing affect in relation to all bodies in any given social scene, the grand composition of which I call affectif. (shrink)

“Art”—what is it? What sort of entities are artworks? “Art”—when is it? Normally, when we visit an art exhibition, when we listen to a concert or when we look at a performing art in a setting, we use to read the titles, the tags or something textual, a threshold not crafted by the author, about the exposed or executed artworks in order to grasp their subject, style, history, and author. But: how does a title, a non-fiction depiction or a pointing, (...) and different ways of para-textual activation, entitle and unable us to such an operation and to live an aesthetic relation? This issue of “Aisthesis” explores the conditions under which it could be useful to distinguish between aesthetic objects and artworks–visual, musical, literary, performing arts– and to admit that the existence of the latter depends on a marginal and basic component of them: tags. This paper identifies, develops, and argues for an interpretation of Mary Astell’s understanding of self-government. On this interpretation, what is essential to self-government, according to Astell, is an agent’s responsiveness to her own reasoning. The paper identifies two aspects of her theory of self-government: an ‘authenticity’ criterion of what makes our motives our own and an account of the capacities required for responsiveness to our own reasoning. The authenticity criterion states that when our motives arise from some external source without (...) validation by our own understanding of the reasons supporting them, then they are not our own. The capacities requisite for responsiveness to our own reasoning are those of examining and evaluating our own motives and of resisting the social pressure to conform to others’ opinions. An upshot of this interpretation of Astell’s theory of self-government is that it reveals her insights into the ways ‘custom’ can undermine an individual’s ability to govern oneself. (shrink)

At the phenomenal level, consciousness can be described as a singular, unified field of recursive self-awareness, consistently coherent in a particualr way; that of a subject located both spatially and temporally in an egocentrically-extended domain, such that conscious self-awareness is explicitly characterized by I-ness, now-ness and here-ness. The psychological mechanism underwriting this spatiotemporal self-locatedness and its recursive processing style involves an evolutionary elaboration of the basic orientative reference frame which consistently structures ongoing spatiotemporal self-location computations as i-here-now. Cognition computes action-output (...) in the midst of ongoing movement, and consequently requires a constant self-locating spatiotemporal reference frame as basis for these computations. Over time, constant evolutionary pressures for energy efficiency have encouraged both the proliferation of anticipative feedforward processing mechansims, and the elaboration, at the apex of the sensorimotor processing hierarchy, of self-activating, highly attenuated recursively-feedforward circuitry processing the basic orientational schema independent of external action output. As the primary reference frame of active waking cognition, this recursive i-here-now processing generates a zone of subjective self-awareness in terms of which it feels like something to be oneself here and now. In this article, Catherine Kirchner-Blanchard et Frédéric Lefrançois question the decolonial stance of Caribbean artists who pursue artistic freedom and agency without relating or comparing their work to the great models of Western art history.

Why and how do norms emerge? Which norms emerge and why these ones in particular? Such questions belong to the ‘problem of the emergence of norms’, which consists of an inquiry into the production of norms in social collectives. I address this question through the ethnographic study of the emergence of ‘norms against violence’ in the political collective Occupy Geneva. I do this, first, empirically, with the analysis of my field observations; and, second, theoretically, by discussing my findings. In consequence (...) of two episodes categorized as sexual assaults that occurred in their camp, the members of Occupy Geneva decided to tackle those issues in a general assembly. Their goal was to amend their first charter of good conduct in order to reform its norms and complete it with norms aiming to regulate ‘facts’ of ‘unjustified violence’. During a collective deliberation, new norms were devised, debated and consensually adopted. The writing of the new charter took place in a second general assembly during which the wording of the written norms was collectively decided. I show that indignation over the sexual assaults was the main motive that led to the collective deliberation, and that the entire process of the making of these norms was characterized by different collective emotions. Indeed, indignation, contempt and fear played major roles in the emergence of norms prohibiting violence, allowing punishment and exclusion of wrongdoers, and prescribing collective intervention against an aggressor to neutralize the threat represented. These findings prompt me to hypothesize that social norms emerge from emotions thanks to the latters’ internal structure; and that emotions provide causal and grounding explanations for this emergence. Thus, emotions allow us to answer the questions: ‘Why do norms emerge?’ and ‘Why do they have their specific forms?’ In short, I argue that social norms have emotional foundations. (shrink)

Cet article s’intéresse au problème de la maintenance, c’est-à-dire au moment où les membres d’un collectif social tentent d’assurer dans le temps l’existence de leur collectif en instituant des règles pour réguler leurs comportements. Ce problème se pose avec acuité lorsque certains membres ne respectent pas ces règles communes. Pour maintenir la coopération sociale, les membres peuvent décider d’instituer des règles secondaires visant à sanctionner les transgressions des règles primaires déjà établies. La maintenance d’un collectif peut ainsi reposer sur l’émergence (...) de pouvoirs déontiques qui donnent aux membres l’autorité de légitimement punir et expulser les transgresseurs. Mais d’où viennent ces règles ? On peut penser qu’elles émergent des émotions éprouvées par les membres envers les transgresseurs. Je le démontre à l’aide d’une étude de cas qui établit que, dans le collectif Occupy Geneva, l’institutionnalisation de normes pour punir, exclure et réintégrer les déviants s’ancraient respectivement dans l’indignation, le mépris et le pardon. -/- This article focuses on the problem of maintenance; that is the moment when the members of a social collective attempt to ensure the existence of their collective over time by instituting rules to regulate their behavior. This problem becomes critical when certain members do not respect the common rules. To maintain social cooperation, members can decide to institute secondary rules aimed at sanctioning the transgressions of the already established primary rules. The maintenance of a collective can thus rely on the emergence of deontic powers that give members the authority to legitimately punish and expel transgressors. But where do these rules come from? The hypothesis is that they emerge from the emotions felt by the members towards the transgressors. I show this with the help of a case study, which establishes that the institutionalization of norms allowing the punishment, the exclusion, and the reintegration of deviants within the “Occupy Geneva” collective, was grounded in indignation, contempt, and forgiveness respectively. Before the Darwinian revolution species were thought to be universals. Since then, numerous attempts have been made to propose new definitions. The twentieth-century German philosopher Nicolai Hartmann defined 'species' as an individual system of processes and a process of life of a higher-order. To provide a clear understanding of Hartmann's conception of species, I first present his method of definition. Then I look at Hartmann's Philosophie der Natur (1950) to present his concepts of "organism" and "species." And I end the (...) paper by pointing out two possible systematic inconsistencies. . Computational chemistry grew in a new era of “desktop modeling,” which coincided with a growing demand for modeling software, especially from the pharmaceutical industry. Parameterization of models in computational chemistry is an arduous enterprise, and we argue that this activity leads, in this specific context, to tensions among scientists regarding the epistemic opacity transparency of parameterized methods and the software implementing them. We relate one flame war from the Computational Chemistry mailing List in order to assess in detail the (...) relationships between modeling methods, parameterization, software and the various forms of their enclosure or disclosure. Our claim is that parameterization issues are an important and often neglected source of epistemic opacity and that this opacity is entangled in methods and software alike. This paper focuses on the conception of an endogenous aesthetic matrix in the Caribbean and the Americas within a decolonial perspective.

We characterize four fruitful and underappreciated epistemic roles played by the concept of an individualized niche in contemporary biology, utilizing results of a qualitative empirical study conducted within an interdisciplinary biological research center. We argue that the individualized niche concept (1) shapes the research agenda of the center, (2) facilitates explaining core phenomena related to inter-individual differences, (3) helps with managing individual-level causal complexity, and (4) promotes integrating local knowledge from ecology, evolutionary biology, behavioral biology and other biological fields. Through the prism of archipelicity, the artistic production of the Afro-American Diaspora reveals its diffractive potential: at once close to and far from its original origins, it unfolds in the in-between of a double consciousness. In his seminal essay, Paul Gilroy calls for the overcoming of binary oppositions in order to better apprehend the complexity of Afro-diasporic intellectual culture, which he sees as specifically transnational (Gilroy, 1993). As inclusive as this theoretical framework may seem, it is challenged by the inherent (...) transcoloniality of the artistic dynamics animating the region of the Black Island Americas. To this day, avatars of the colonial model persist in the Lesser and Greater Antilles and in the majority of the coastal nations of the Caribbean basin. To a certain extent, these schemes continue to influence the aesthetic-political choices of the region’s visual artists and performers, while providing them with symbolic codes that can be interpreted as signs of belonging to the Afro-Trans American diaspora. It is therefore a challenge to claim any form of diasporic citizenship in such a shifting and uncertain configuration. What is thought to be relevant from an individual or community perspective may prove to be institutionally subversive. In the syncretic tradition of Cuba and Brazil, the same code can be given different semiotic meanings depending on the political and pragmatic context. This article therefore takes an ethno-critical look at the contribution of such practices to the broader framework of archipelagic networks and map zones of Afro-diasporic connectivity in a trans-American context. Intentional explanation, according to Elster, seeks to elucidate an action by showing that it was intentionally conducted, in order to bring about certain goals . Intentional actions furthermore, are rational actions: they imply that agents establish a connection between the goals they target and the means that are appropriate to reach them, by way of different beliefs about the means, the goals and the environment. But how should we understand intentional actions in the light of philosophical research on emotions, rationality, (...) and normativity? This question is the departure point of this article. Various philosophers have analyzed the relationships between rationality and emotion, those between emotion and normativity, and those between emotion and intentional action. Nonetheless, their theses are scattered and do not offer an integrative view on how rationality, normativity and emotions work from the standpoint of intentional explanation. By using de Sousa’s distinction between the epistemic and the strategic modes of rationality as a theoretical framework, this article proposes therefore to remedy this deficit by unifying these philosophical insights with the goal of elaborating a theory of intentional explanation which brings together rationality, normativity and emotions. On conçoit souvent la jalousie comme une émotion ayant pour objet les relations de proximité (amour, amitié, fratrie, etc.). Elle a généralement mauvaise presse et est typiquement envisagée comme une émotion moralement condamnable, voire comme un vice. Or, la jalousie ne porte pas uniquement sur les relations de proximité : elle peut également porter sur divers biens (prestige, richesses, biens matériels, privilèges, etc.). Par ailleurs, certains auteurs soutiennent que des cas de jalousie pourraient être moralement justifiés, voire que la jalousie (...) pourrait être une vertu. La jalousie paraît également jouer un rôle dans l’institution et le maintien d’institutions visant à perpétuer des inégalités entre les individus jaloux de leurs avantages et ceux qu’ils envisagent comme des concurrents cherchant à les déposséder de leurs biens. De fait, la jalousie paraît utile pour la théorie politique de par les liens qu’elle entretient avec la justice distributive. Cet article propose, dans la première section, une discussion portant sur la nature de la jalousie où elle est contrastée avec l’envie et l’indignation. Dans la seconde section, on se demandera si la jalousie est un vice, ou si elle peut être parfois moralement justifiée, ou même être une vertu. La troisième section traitera les rôles joués par la jalousie collective dans la justice distributive et la fondation et le maintien d’institutions sociales visant à protéger les intérêts des jaloux. What are the motivational bases that help explain the various normative judgements that social agents make, and the normative reasoning they employ? Answering this question leads us to consider the relationships between thoughts and emotions. Emotions will be described as thought-dependent and thought-directing, and as being intimately related to normativity. They are conceived as the grounds that motivate social agents to articulate their reasoning with respect to the values and norms they face and/or share in their social collective. It is (...) argued that because they are modes of thinking, emotions generate cognitive activities that relate to the making of evaluative and deontic judgements, the utterance of speech acts, the mastering of normative concepts and the building of arguments. Furthermore, each type of emotion generates its own constitutive judgements and structures normative thinking according to its own logic. The main thesis is that emotions provide sociological explanations for social agents’ thinking and speech, for emotions are precisely what motivate and, especially, structure normative reasoning and language. Being observable in language, emotions allow us to explain a) how social subjects reason and argue through norms and values, and b) how social subjects through their speech acts can contribute to the (un-)making of the social world. A prominent version of emotional cognitivism is the view that emotions are preceded by awareness of value. In a recent paper, Jonathan Mitchell (2019) has attacked this view (which he calls the content-priority view). According to him, extant suggestions for the relevant type of pre-emotional evaluative awareness are all problematic. Unless these problems can be overcome, he argues, the view does not represent a plausible competitor to rivaling cognitivist views. As Mitchell supposes, the view is not mandatory since its core (...) motivations can be accommodated by competing views, too. I argue that Mitchell's case against the content-priority view is unconvincing as it misconceives the principal motivation for the view. As I show, properly reconstructed, this motivation provides a strong case for the indispensability of the view to any adequate cognitivist treatment of emotion. Moreover, Mitchell's survey of candidates for pre-emotional value awareness can be seen to rest on problematic phenomenological assumptions. (shrink)

Fallibilism, as a fundamental aspect of pragmatic epistemology, can be illuminated by a study of law. Before he became a famous American judge, Oliver Wendell Holmes, Jr., along with his friends William James and Charles Sanders Peirce, associated as presumptive members of the Metaphysical Club of Cambridge in the 1870s, recalled as the birthplace of pragmatism. As a young scholar, Holmes advanced a concept of legal fallibilism as incremental community inquiry. In this early work, I suggest that Holmes treats common (...) law cases more like scientific experiments than as deductive applications of already clear rules. Common law rules may be seen as a product of 1) the conflicts that occur in society, 2) the channeling of conflicts into legal disputes, 3) the gradual accumulation of judicial decisions classified into groups, and 4) the development of consensual understanding, expressed in rules and principles, as to how future cases should be classified and decided. This does not involve only lawyers and judges. Especially in controversial cases, it may indirectly involve an entire community. The legal process is seen as an extended intergenerational process of inquiry. It illuminates the relation of thought, expression, and conduct among a community of inquirers, applied to the problems of social ordering. (shrink)

Marie Oldfield, Pro Bono Economics & Refugee Council. Over half the total applications for asylum the UK receives each year are initially rejected, yet nearly a third of these initial rejections are subsequently overturned on appeal. This process that fails to get decisions right first time imposes significant costs, not just on the applicants themselves, but also more widely on UK taxpayers. Asylum seekers are not entitled to welfare benefits nor employment except in some limited cases, and are often (...) placed in unsuitable conditions with lack of appropriate support to prepare their case for asylum. These unfortunate circumstances mean that they are unable to gather and present all the required evidence first time, even when the case for asylum is legitimate. As a result, the application is rejected and thus begins a cycle of appeals that might eventually lead to a successful outcome for the asylum seeker but will, in the process, burden the taxpayer with unnecessary administrative cost and cause the asylum seeker needless distress and prevent them from accessing suitable economic opportunities. • Our study estimates that there are approximately 4,000 initial rejections that are successfully appealed each year and, with each appeal incurring direct administrative costs of around £1,000, the price tag of incorrect initial decisions adds up to a hefty £4 million per year in unnecessary administrative costs alone. • There are other costs, too, that negatively impact asylum seekers and taxpayers, albeit in a more indirect manner. The longer the appeals process is dragged out, the more delay there is to successful asylum seekers entering the labour market which means lost economic activity and forgone tax revenue for the Exchequer. Long periods of unemployment also result in skills attrition and lower the probability of the asylum seeker successfully entering the labour market in the future. • A lengthy appeals process heightens stress and worsens mental health in asylum seekers, a group arguably already more vulnerable on this front. Unnecessary human suffering aside, there is also a monetary cost borne by the taxpayer should NHS mental health services become involved. Thus, there is a pressing and viable case for providing asylum seekers a stable environment in which to complete their applications for asylum. This would increase the likelihood of reaching correct decisions in the first instance, avoid unnecessary administrative costs of an arduous appeals process, enable successful asylum seekers to access the labour market and contribute to the Exchequer, and avoid placing extra demands on already strained NHS mental health services. The central aim of this article is to specify the ontological nature of constitutive mechanistic phenomena. After identifying three criteria of adequacy that any plausible approach to constitutive mechanistic phenomena must satisfy, we present four different suggestions, found in the mechanistic literature, of what mechanistic phenomena might be. We argue that none of these suggestions meets the criteria of adequacy. According to our analysis, constitutive mechanistic phenomena are best understood as what we will call ‘object-involving occurrents’.
